This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.getsetplay.co website and GetSetPlay application for mobile and handheld devices.

These terms of use (the “Terms of Use”) govern your use of our website www.getsetplay.co (the “Website”) and our “GetSetPlay” application for mobile and handheld devices (the “App”). The Website and the App are jointly referred to as the “Platform”. Please read these Terms of Use carefully before you use the services. If you do not agree to these Terms of Use, you may not use the services on the Platform, and we request you to uninstall the App. By installing, downloading or even merely using the Platform, you shall be contracting with GetSetPlay and you signify your acceptance to the Terms of Use and other GetSetPlay policies (including but not limited to the Cancellation & Refund Policy and Privacy Policy) as posted on the Platform from time to time, which takes effect on the date on which you download, install or use the Services, and create a legally binding arrangement to abide by the same.

These Terms of use supplement and are in addition to Our Privacy Policy, which also apply to your Use of this Site and Application. Our Privacy Policy explains the personal data that We collect about you and process when you Use the Site or Application. By Using this Site or Application, you are deemed to have read, understood and agreed to Our Privacy Statement in its entirety, consented to the processing of your personal data and you warrant that all data provided by you is accurate.

For the purpose of these Terms of Use, wherever the context is required” you” shall mean any natural or legal person who has agreed to become a buyer or customer on the Platform by providing Registration Data while registering on the Platform as a registered user using any computer systems.

Information about Us

This Site and Application is operated by GetSetPlay Solutions Private Limited ("We", "Our" or "Us").

We are are engaged in organising sports and other recreational events as well as providing an internet based booking platform for and in connection with Our as well as third party sports and other recreational events and sports facilities & venues through Our Website and Mobile Application either by Our self or through Our subsidiaries, affiliates or third-party service providers ("Service").

Amendments

These Terms of Use and any other document incorporated by reference are subject to modifications at any time. GetSetPlay reserves the right to modify or change these Terms of Use and other policies at any time by posting changes on the platform, and you shall be liable to update yourself of such changes, if any, by accessing the changes on the domain. You shall, at all times, be responsible for regularly reviewing the Terms of Use and the other GetSetPlay policies and note the changes made on the Platform. If GetSetPlay proposes any changes to the Terms of Use, you will be informed of the same by way of a 'pop up' which will appear on your screen. You are expected to review the revised term(s) and provide your consent. If you fail to do so, your existing registration will also stand terminated.

Usage Eligibility Criteria

You need not register with GetSetPlay to simply visit and view the Platform, but to access and participate in certain features of the Platform, you will need to create a password-protected account ("Account"). To create an Account, you must submit your name, mobile number and/or email address through the account registration page/screen on the GetSetPlay Platform and create a password. You will also have the ability to provide additional optional information, which is not required to register for an account but maybe helpful to GetSetPlay in providing you with a more customized experience when using the Platform. You may also register for an Account using your existing Facebook, Google, Twitter or any such other account and log-in credentials (your "Third-Party Site Account").
You will be eligible to use the Services only when you fulfil all of the following conditions:
1. You have attained at least 18 (eighteen) years of age; and
2. You are competent to enter into a contract under the Applicable Laws.
We reserve the right to suspend or terminate your Account and your access to the Services:
1. if any User Content provided during the registration process or thereafter proves to be inaccurate, not current or incomplete;
2. if it is believed that your actions may cause legal liability for you, other Users or us; and/or
3. if you are found to be non- compliant with these Terms of Use.
If you reside in a jurisdiction that restricts the use of the Service because of age, or restricts the ability to enter into contracts such as this Terms of use due to age, you must abide by such age limits.
You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Account. You shall notify GetSetPlay immediately in case of any breach of security or any unauthorized use of your Account. Similarly, you shall never use another's Account without prior consent from GetSetPlay. You agree that you will not misrepresent yourself or represent yourself as another User of the GetSetPlay Platform. You hereby expressly acknowledge and agree that you will be liable for any losses, damages (whether direct or indirect) caused to you, GetSetPlay or any others as a result of unauthorized use of your Account.

Registration and Account

You may access the Platform by registering to create an account (“ GetSetPlay Account”) and become a member (“ Membership”); or you can also register to join by logging into your account with certain third party social networking sites (“ SNS”) (including, but not limited to, Facebook); each such account, a “ Third Party Account”, via our Platform, as described below. The Membership is limited for the purpose and are subject to the terms, and strictly not transferable. As part of the functionality of the Platform services, you may link your GetSetPlay Account with Third Party Accounts, by either:
1. providing your Third-Party Account login information to us through the Platform; or
2. allowing us to access your Third-Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third-Party Account.
You represent that you are entitled to disclose your Third Party Account login information to us and/or grant us access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating us to pay any fees or making us subject to any usage limitations imposed by such third party service providers.
By granting us access to any Third Party Accounts, you understand that we will access, make available and store (if applicable) any content or information that you have provided to and stored in your Third Party Account (“ SNS Content”) so that it is available on and through the Platform via your GetSetPlay Account.
You shall ensure that the Registration Data provided by you is accurate, complete, current, valid and true and is updated from time to time. We shall bear no liability for false, incomplete, old or incorrect Registration Data provided by you.
We reserve the right to suspend or terminate your Account with immediate effect and for an indefinite period, if We have a reason to believe that the Registration Data or any other data provided by you is incorrect or false, or that the security of your Account has been compromised in any way, or for any other reason We may find just or equitable.
Except for the Registration Data or any other data submitted by you during the use of any other service offered through Site (Permitted Information), GetSetPlay does not want you to, and you should not, send any confidential or proprietary information to GetSetPlay on the Site or otherwise, unless otherwise is required by Applicable Laws. In accepting these Terms of use you agree that any information or materials that you or individuals acting on your behalf provide to GetSetPlay other than the Permitted Information will not be considered confidential or proprietary.
It is your responsibility to check to ensure that you download the correct application for your device. We are not liable if you do not have a compatible mobile device or if you download the wrong version of the Application for your mobile device. We reserve the right to terminate the Service and the use of the Application should you be using the Service or Application with an incompatible or unauthorized device.
We allow you to open only one Account in association with the Registration Data provided by you. In case of any unauthorized use of your Account please immediately reach Us at contact@getsetplay.co.
We will create your GetSetPlay Account for your use of the Platform services based upon the personal information you provide to us or that we obtain via an SNS, as described above. You may only have one GetSetPlay Account and not permitted to create multiple accounts. If found, you having multiple accounts, GetSetPlay reserves right to suspend such multiple account without being liable for any compensation.
We reserve the right to suspend or terminate your GetSetPlay Account and your access to the Services
1. if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete;
2. if it is believed that your actions may cause legal liability for you, other users or us; and/or
3. if you are found to be non- compliant with the Terms of Use.

Your Use of this Platform

Your Use of this Site and Application's published links, messages, material or information ("Content") must only be for lawful purposes and must not be in a way that infringes Our or anyone else's rights or restricts or inhibits ours or anyone else's enjoyment of this Site or Application.
You agree, undertake and confirm that your use of the GetSetPlay Platform shall be strictly governed by the following binding principles:
You shall not host, display, upload, download, modify, publish, transmit, update or share any information which:
1. belongs to another person and which you do not have any right to;
2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, slanderous, criminally inciting or invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever; or unlawfully threatening or unlawfully harassing including but not limited to any content which is in violation of the provisions of the Indian Penal Code, 1860;
3. is misleading or misrepresentative in any way;
4. is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
5. harasses or advocates harassment of another person;
6. involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";
7. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
8. infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity;
9. contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
10. provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
11. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
12. contains video, photographs, or images of another person (with a minor or an adult);
13. tries to gain unauthorized access or exceeds the scope of authorized access to the GetSetPlay Platform or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the GetSetPlay Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
14. engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising and pyramid schemes, or the buying or selling of products related to the GetSetPlay Platform. Throughout these Terms of Use, GetSetPlay prior written consent means a communication coming from GetSetPlay's legal department/authorised representative, specifically in response to your request, and expressly addressing and allowing the activity or conduct for which you seek authorization;
15. solicits gambling or engages in any gambling activity which is or could be construed as being illegal;
16. harm minors in any way;
17. infringes any patent, trademark, copyright or other intellectual property rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent;
18. violates any law for the time being in force;
19. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;
20. directly or indirectly, offers, attempts to offer, trades or attempts to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force
You shall not conduct any systematic or automated data collection activities (including scraping, data mining, data extraction, data harvesting, 'framing' (iframes), article 'spinning') on or in relation to the GetSetPlay Platform without express written consent from GetSetPlay Solutions Private Limited.
You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the GetSetPlay Platform or any content, or in any way reproduce or circumvent the navigational structure or presentation of the GetSetPlay Platform or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the GetSetPlay Platform. We reserve our right to prohibit any such activity.
You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about us or the brand name or domain name used by us including the name GetSetPlay, or otherwise engage in any conduct or action that might tarnish the image or reputation, of GetSetPlay on the Platform or otherwise tarnish or dilute any of GetSetPlay's trade or service marks, trade name and/or goodwill associated with such trade or service marks, as may be owned or used by us. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the GetSetPlay Platform or GetSetPlay's systems or networks, or any systems or networks connected to GetSetPlay.
You shall at all times ensure full compliance with the applicable provisions, as amended from time to time, of (a) the Information Technology Act, 2000, India and the rules thereunder; (b) all applicable domestic laws, rules and regulations (including the provisions of any applicable exchange control laws or regulations in force); and (c) international laws, foreign exchange laws, statutes, ordinances and regulations (including, but not limited to goods and service taxes, income tax, and local levies) regarding your use of our Service and your listing, purchase, solicitation of offers to avail our Services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.
We will monitor your messages and interaction on the GetSetPlay Platform and you indulged in in any form of advertising or solicitation, we reserve the right to restrict the number of messages or emails which a User may send to other Users in any period which we deem appropriate in its sole discretion.
We reserve the right, but have no obligation, to monitor the materials posted on the Platform. GetSetPlay shall have the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms of Use. Notwithstanding this right, you remain solely responsible for the content of the materials you post on the GetSetPlay Platform and in your private messages. Please be advised that such content posted does not necessarily reflect GetSetPlay's views. In no event shall GetSetPlay assume or have any responsibility or liability for any content posted or for any claims, damages or losses resulting from use of content and/or appearance of content on the GetSetPlay Platform. You hereby represent and warrant that you have all necessary rights in and to all content which you provide and all information it contains and that such content shall not infringe any proprietary or other rights of third parties or contain any libellous, tortious, or otherwise unlawful information.
It is possible that other Users (including unauthorized Users or 'hackers') may post or transmit offensive or obscene materials on the GetSetplay Platform and that you may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about you due to your use of the GetSetPlay Platform, and that the recipient may use such information to harass or injure you. We do not approve of such unauthorized uses, but by using the GetSetPlay Platform You acknowledge and agree that we are not responsible for the use of any personal information that you publicly disclose or share with others on the GetSetPlay Platform. Please carefully select the type of information that you publicly disclose or share with others on the GetSetPlay Platform.

You acknowledge and agree that GetSetPlay facilitates the hosting of products, services, events and arenas which are offered by third party providers ("Service Provider") and GetSetPlay does not:
1. Make any warranties, whether express or implied of the quality of the products, services, events or arenas which are offered by the Service Providers;
2. Endorse, or confirm that a certain product, products, services, events or arenas which are provided or offered by the Service Provider, confirm to a certain quality or has been rated in a certain format;
3. Assume any liability if the products, services, events or arenas provided by the Service Provider do not meet the expectation of the User of if the User suffers any loss or damage, including any bodily injury as a consequence of using such products, services, events or arenas;
4. Assume any liability in the event of any change, alternation, amendment or replacement to the products, services, events or arenas offered by the Service Provider.
You may not be able to avail our Services if your current location is outside our current scope of Service. We will keep you informed of the same at the time of confirming your order booking.
You understand that our liability ends once your reservation period has ended.
We constantly strive to provide you with accurate information on the Platform. However, in the event of an error, we may, in our sole discretion, contact you with further instructions.
If you use the Platform, you do the same at your own risk.
You agree that the Services shall be provided by us only during the working hours of the relevant Service Providers.
You may order Our Services using Our Site. You will be charged the applicable fees set forth in the schedule of pricing, as may be prescribed from time to time.
The Total Fee for the Services will be provided through the Site at the time the Services are ordered. You shall be subject to terms regarding minimum quantities to be ordered and minimum service fees.
By using the Application or the Service, you further agree that:
1. you will only use the Service or download the Application for your sole personal use and will not resell or assign it to a third party;
2. you will not use an Account that is subject to any rights of a person other than you without appropriate authorization;
3. you will not use the Service or Site for unlawful purposes;
4. you will not try to harm the Service, Site or our network in any way whatsoever;
5. you will provide GetSetPlay with such information and documents which GetSetPlay may reasonably request;
6. you will only use an authorized network to avail the Service;
7. you are aware that when requesting Services, whether by message, via Site or calling the call centre of GetSetPlay, standard messaging charges, data charges, voice charges, as applicable, of the your and Our phone network service providers, will apply;
8. you will comply with all Applicable Law from your country of domicile and residence and the country, state and/or city in which you are present while using the Site or Service; and
9. you are aware of and shall comply with the Information Technology Act, 2000 and the rules, regulations and guidelines notified thereunder.
GetSetPlay reserves the right to immediately terminate the Service and the use of the Application in the event of non-compliance with any of the above requirements. Further, GetSetPlay will store the information provided by you or record your calls for contacting you for all Service-related matters. You shall promptly inform GetSetPlay on any change in the information provided by you.
GetSetPlay will be entitled to enter into any tie-up in terms of joint-venture or otherwise with any other institution engaged in the business of providing services analogous and/or similar to those herein contained. In such case, depending upon the modality and the mechanism as may be devised, you will be provided with the services by GetSetPlay jointly and/or severally with the party/ies in joint venture. You hereby give your irrevocable consent and permission to such a tie-up. In the event of such a tie-up, the terms and conditions herein contained will, mutatis mutandis, become applicable in respect of such tie-up arrangement also.
You might be required to provide your credit or debit card details to the approved payment gateways while making the payment. In this regard, you agree to provide correct and accurate credit/ debit card details to the approved payment gateways for availing the Services. You shall not use the credit/ debit card which is not lawfully owned by you, i.e. in any transaction, you must use your own credit/ debit card. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation or court order. You will be solely responsible for the security and confidentiality of your credit/ debit card details. We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of your credit/ debit card.

Confirmation of Orders

GetSetPlay shall, upon receiving the Order request from you in the manner set out above, proceed to confirm or decline the Order based on the ability to provide Service which shall be informed to you vide an SMS or email. In the event the Order is confirmed, you shall check the Order details and if there is any incorrect detail, the same needs to be informed to us immediately at contact@getsetplay.co.
You shall bear the consequences and damages for any delay that may be caused to you due to your failure to check the confirmation SMS or email or failure to inform GetSetPlay of the incorrect details immediately.
Certain selective customers will be eligible to avail the Service under a Guest Orders™ feature or special memberships, provided by GetSetPlay. Such customers will also be bound by the terms and conditions set out herein.

Payment

GetSetPlay shall charge Total Fee for the Service which shall be determined and amended at the sole and absolute discretion of GetSetPlay.
You shall be required to pay such Additional Fee, which will form part of the receipt of the Total Fee.
You shall be required to pay such Cancellation Fee, which will form part of the receipt of the Total Fee.
In addition to the Total Fee, you may be required to pay such other charges incurred by you for availing the Service in cash, which are not included in the receipt of the Total Fee.
The Total Fee will be collected by GetSetPlay from you at the time of placing an order for the Service.
GetSetPlay shall provide a receipt of the Total Fee payable by you upon successful placement of the order for the Service.
All applicable taxes in respect of the Order Value, Convenience Fee, Additional Fee, Cancellation Fee shall be borne and payable by you to GetSetPlay.
You shall choose to pay for the Service Fee by either of the following four methods:
1. E-Wallet payment: GetSetPlay offers you the facility of making an online payment through an E-Wallet powered by a third-party payment processor (Payment Processor). E-Wallet money will not be applicable on Orders made through the phone or while the user is not logged into his/her Account on the Site. The processing of payments, in connection with your use of the E-Wallet will be subject to the terms, conditions, and privacy policies of the Payment Processor that GetSetPlay engages for the purpose. GetSetPlay will not be responsible for any errors by the Payment Processor in any manner.
2. Credit Card/ Debit Card/ Net Banking Payment: Total Fee shall be affected using the services of an entity providing payment gateway/processor services (PG), authorized by GetSetPlay. Such PG may either be GetSetPlay or any of its affiliates or partners or unrelated third parties. You agree and undertake to share relevant payment details including credit/debit card details (Card Details) with the PG for the successful completion of payment towards Total Fee to GetSetPlay and authorize the PG to complete such transactions. In this respect, it is clarified that all PGs whose services are utilized for the purposes of the Site and/or Application and/or Services shall be PCI-DSS (Payment Card Industry â€ “Data Security Standard) compliant. Your authorization permits the PG to debit or credit the bank account associated with your payment details. Your authorization further permits the PG to use your Card Details for the processing of transactions initiated by you at any of GetSetPlay ™s affiliates. Your authorization will remain in effect as long as you maintain an Account with Us. In the event you delete your Card Details with the PG or if you delete your Account, the PG will not process any further transactions initiated by you at the Site or Application and at the sites of any of GetSetPlay ™s affiliates. Your authorization under this Clause is subject to any other terms and conditions of the PG.
Any payment related issue, except when such issue is due to an error or fault in the Site, shall be resolved between you and the Payment Processor. GetSetPlay shall not be responsible for any unauthorized use of your E-Wallet during or after availing the Services on the Site.

Cancellation and Refund Policy

GetSetPlay does not set cancellation and refund policies for the events listed on behalf of the third-party service providers on its website or web-based application. It is the responsibility of the third-party service providers to communicate its refund policy to you and to issue refunds in accordance therewith. Consequently, your requests for refund of your Order should be directed to the third-party service providers with whom you make a booking through Our website and in no event shall be directed to GetSetPlay. Any refund-related issues or disputes shall be strictly between the you and the third-party service providers; GetSetPlay shall not be liable for any refund-related claims in connection with event services.
In case you wish to cancel booking for a venue posted by a third-party service provider on GetSetPlay, then the booking amount shall be refunded in the following manner:
1. Online Payment (Full):
  1. 100% refund if venue booking is cancelled more than 2 hours before the first slot start time.
  2. 70% refund if venue booking is cancelled more than 1 hours before the first slot start time.
  3. 50% refund if venue booking is cancelled within 1 hour before the first slot start time.
2. Online Payment (Advance):
  1. 100% refund if venue booking is cancelled more than 3 hours before the first slot start time.
  2. No refund if venue booking is cancelled less than 3 hours before the first slot start time.
Refund for Order due to failed online ticket booking will be processed within 7-10 working days.
GetSetPlay reserves the right to change/modify this cancellation and refund policy without any prior notice.

Access to the platform, accuracy and security

We endeavour to make the GetSetPlay Platform available 24/7. However, we do not represent that access to the GetSetPlay Platform will be uninterrupted, timely, error free, free of viruses or other harmful components or that such defects will be corrected.
We do not warrant that the GetSetPlay Platform will be compatible with all hardware and software which you may use. We shall not be liable for damage to, or viruses or other code that may affect, any equipment (including but not limited to your mobile device), software, data or other property as a result of your download, installation, access to or use of the GetSetPlay Platform or your obtaining any material from, or as a result of using the GetSetPlay Platform. We shall also not be liable for the actions of third parties
We do not represent or warranty that the information available on the GetSetPlay Platform will be correct, accurate or otherwise reliable.
We reserve the right to suspend or withdraw access to the GetSetPlay Platform to you personally, or to all Users temporarily or permanently at any time without notice.

Disclaimers

The GetSetPlay Platform may be under constant upgrades, and some functions and features may not be fully operational.
Due to the vagaries that can occur in the electronic distribution of information and due to the limitations inherent in providing information obtained from multiple sources, there may be delays, omissions, or inaccuracies in the content provided on the GetSetPlay Platform or delay or errors in functionality of the GetSetPlay Platform. As a result, we do not represent that the information posted is correct in every case.
We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of credit/ debit cards.
You acknowledge that third party services are available on the GetSetPlay Platform. We may have formed partnerships or alliances with some of these third parties from time to time in order to facilitate the provision of certain services to you. however, you acknowledge and agree that at no time are we making any representation or warranty regarding any third party's services nor will we be liable to you or any third party for any consequences or claims arising from or in connection with such third party including, and not limited to, any liability or responsibility for, death, injury or impairment experienced by you or any third party. You hereby disclaim and waive any rights and claims you may have against us with respect to third parties’ services.
Apart from a cursory background verification, GetSetPlay does not make any representation or warranty as to the item-specifics (such as legal title, creditworthiness, identity, etc.) of any of the Users. You are advised to independently verify the bona fides of any particular User that you choose to deal with on the GetSetPlay Platform and use your best judgment in that behalf.

In no event will we be liable for any damages (including, without limitation, direct, indirect, incidental, special, consequential or exemplary damages, damages arising from personal injury/wrongful death, and damages resulting from lost profits, lost data or business interruption), resulting from any services provided by any third party through the GetSetPlay Platform, whether based on warranty, contract, tort, or any other legal theory and whether or not we are advised of the possibility of such damages. However, we will attempt to refund any amount paid by the User, at our sole discretion, and our liability in this regard, if any will be limited to just the amount paid by the User with respect to the said booking on the GetSetPlay Platform.
Nothing in these disclaimers limits the liability of GetSetPlay in respect of:
1. Death or personal injury caused by the negligence of or its agents or employees;
2. Fraud or fraudulent misrepresentation by its agents or employees;
3. Any matter which it would be illegal or unlawful for it to exclude or limit, or to attempt or purport to exclude or limit, its liability.
Nothing in these Terms of Use constitutes, or is meant to constitute, advice of any kind. If you require advice in relation to any legal, financial or medical matter, you should consult an appropriate professional.

Breach of Terms

You hereby acknowledge and agree that GetSetPlay, in its sole and absolute discretion, has the right (but not the obligation) to delete, terminate, or deactivate your Account, block your email or IP address, cancel the terminate your access to or participation in the use of the GetSetPlay Platform (or any part thereof), or remove and discard any content on the GetSetPlay Platform ("Termination"), immediately and without notice, for any reason, including without limitation, if GetSetPlay believes or has reason to believe that you have violated any provision of the Terms of Use.
You hereby indemnify and undertake to keep GetSetPlay indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by to a third party in settlement of a claim or dispute) incurred or suffered by it, that arise out of any breach by you of any provision of these Terms of Use, or arising out of any claim that you have breached any provision of these Terms of Use.
Effect of Termination.
1. Upon termination of your Account, your right to participate in the GetSetPlay Platform shall automatically terminate. You acknowledge and agree that your right to receive any Services hereunder is conditional upon your proper use of the GetSetPlay Platform, your adherence to the Terms of Use, the continuous activation of your Account, and your permitted participation in the GetSetPlay Platform. Notwithstanding the foregoing, residual data may remain in the GetSetPlay system.
2. If you provided a valid email address during registration, GetSetPlay will notify you via email of any such termination or cancellation, which shall be effective immediately upon GetSetPlay delivery of such notice.
3. Upon Termination, you shall promptly destroy all copies of GetSetPlay data and other content in your possession or control. You further acknowledge and agree that GetSetPlay shall not be liable to you or any third party for any termination of your access to the GetSetPlay Platform. Upon Termination of Service, GetSetPlay retains the right to use any data collected from your use of the GetSetPlay Platform for internal analysis and archival purposes. In no event is GetSetPlay obligated to return any submitted content to you. Clauses in the Terms of Use regarding Termination, Intellectual Property, Dispute Resolution, Disclaimers, Limitations of liability, Indemnification, Treatment of information User Content, and third-party content will survive expiration or termination of the GetSetPlay Platform and/or your Account.
4. You agree to indemnify and hold GetSetPlay and its officers, managers, Registered Users, affiliates, successor, assignees, directors, agents, suppliers and employees harmless from any claim or demand, including reasonable attorneys' fees and court costs, made by any third party due to or arising out of such Termination.
5. We may any time at our sole discretion reinstate suspended/terminated Users. A terminated User may not register or attempt to register with us or use the GetSetPlay Platform in any manner whatsoever until such time that such User is reinstated by us.

Intellectual Property

We are either the owner of intellectual property rights or have the non-exclusive, worldwide, perpetual, irrevocable, royalty free, sub-licensable (through multiple tiers) right to exercise the intellectual property, in the GetSetPlay Platform, and in the material published on it.
You may print off one copy, and may download extracts, of any page(s), files or other content from the GetSetPlay Platform for your personal reference and you may draw the attention of others within your organisation to material available on the GetSetPlay Platform.
You must not redistribute any material from the GetSetPlay Platform and where it has been specifically and expressly made evident by GetSetPlay that certain content is specifically made available for redistribution, it may be redistributed only within your organization, and as intended by GetSetPlay.
You must not republish material from the GetSetPlay Platform on any other print or digital media platform, or display in material on the GetSetPlay Platform in public. You must also not republish or reproduce any material from the GetSetPlay Platform through the use of iframes or screen scrapers.
You must not modify or edit any materials you have printed off or downloaded from the GetSetPlay Platform, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
You must not use, reproduce, duplicate, copy, sell, sub-license or rent out any part of the materials on the GetSetPlay Platform for commercial purposes without obtaining a licence to do so from us or our licensors.
If you print off, copy or download any part of the GetSetPlay Platform in breach of these Terms of Use, your right to use the GetSetPlay Platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Third Party Content

We cannot and will not assure that other Users are or will be complying with the foregoing rules or any other provisions of these Terms of Use, and, as between you and us, you hereby assume all risk of harm or injury resulting from any such lack of compliance.
You acknowledge that when you access a link that leaves the GetSetPlay Platform, the site you will enter into is not controlled by us and different terms of use and privacy policy may apply. By assessing links to other sites, you acknowledge that we are not responsible for those sites. We reserve the right to disable links to and / or from third-party sites to the GetSetPlay Platform, although we are under no obligation to do so.

Severability If any of these Terms of Use should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms of Use are intended to be effective, then to the extent and within the jurisdiction where that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining Terms of Use shall survive, remain in full force and effect and continue to be binding and enforceable.

Assignment GetSetPlay may, at its sole discretion, at any time, assign or transfer or sub contract or purport to assign or transfer or subcontract its obligations under these Terms of Use to any other person or entity. However, you shall not assign or transfer or sub contract or purport to assign or transfer or subcontract your obligations under these Terms of Use to any other entity or person.

Governing Law and Dispute Resolution These Terms of Use are governed by the laws of India. Any action, suit, or other legal proceeding, which is commenced to resolve any matter arising under or relating to the GetSetPlay Platform or these Terms of Use, shall be subject to the jurisdiction of the courts at Mumbai, India.
